GENERAL

Nothing in these terms of use shall restrict or exclude any liability that we have to any party which cannot be excluded by law. These terms of use shall be governed by European law and the courts of Italy shall have exclusive jurisdiction over any disputes arising in relation with this website.

Mark Farhat Giusti Company will endeavour to allow uninterrupted access to this website, but due to the nature of the Internet and other factors, access may be suspended, restricted or terminated at any time.

FORMATION OF CONTRACT AND GOVERNING LAW

A contract between you and Mark Farhat Giusti for the purchase of our goods will exist once we confirm your order via email. The formation of this contract will be deemed complete and your confirmation of it will be deemed received at the time and date of the sending of the email, regardless of whether, for reasons outside of our control, you have not received that email. 

The contract shall be deemed to have been concluded in the Italy and shall be governed by the laws of Italy, and you and Mark Farhat Giusti irrevocably submit to the non-exclusive jurisdiction of the Italian courts.

All purchases made from Mark Farhat Giusti are for the personal or gift use of the buyer only and are not to be used for commercial purposes, re-sale or any other commercial benefit. Mark Farhat Giusti reserves the right to restrict multiple quantities of any item being shipped to any one customer or postal address.

RETURNS & REPAIRS

RETURNING A PRODUCT

Should you wish to return an item, we are happy to offer an exchange or refund where possible, provided items are returned to Mark Farhat Giusti within:

14 days of receipt for full-priced goods, or 

 7 days of receipt for sale/promotion items

All returns must be in perfect condition, and within their original packaging. We are unable to offer any exchanges or refunds on items that are scratched, damaged or that are not in their undamaged original packaging. In these situations, the items will be returned at your own cost.

Please note that we are unable to consider any return or refund if the original sealed tag has been broken or damaged.

EXCHANGES

If you are exchanging a product and the value of the new item is less than that of the one you are returning, we will refund the difference via your original payment method.

If exchanging the goods and the value of the new item is greater than the one you are returning, additional payment will be required. 

Upon exchanging a product, you will be eligible to pay a new postage and packaging charges. Please also retain your original invoice as this may be asked for as proof of purchase.

REFUNDS

If returning goods for a refund, please follow the above protocol. Any funds being returned to you shall can only be actioned via original payment method.

Refunds normally show within 72 hours of being processed, however please be aware that some card issuers may take longer to reallocate funds, up to 90 days, which is beyond the control of Mark Farhat Giusti.

CHANGES & CANCELLATIONS

To change an order please contact our customer services team with you your order number. Please note, that as we generally process and prepare your order for dispatch immediately, you may not be able to change your order, but instead please follow the "returns" process.

CANCELLATION WITHIN SEVEN DAY COOLING OFF PERIOD

Under the Distant Selling Regulations, customers within EU have the right to cancel the contract for purchase with Mark Farhat Giusti at any time within the seven working days of the day after the day on which the customer receives the goods (the "seven day cooling off period")

To cancel your contract within the seven day cooling off period, please notify us in writing by email or post before the expiry of the cooling off period. Please package the relevant goods securely and send them to us within 21 days following the date the items were delivered to you. All returns must be in perfect condition and with their original packaging.

Please note that you will responsible for the cost of returning the items to us unless we delivered the items to you in error, or if the item is damaged or defective. If we do not receive the item back from you with the delivery slip, we may arrange of collection of the item from your residence at your cost.

REPAIRS

All Mark Farhat Giusti goods carry a 6-month guarantee from the date of purchase. If within this period you detect a fault with your goods, they will be repaired at no extra cost (proof of purchase may be required).

Please note that Mark Farhat Giusti does not give authority to purchaser to decide what constitutes returned goods that are faulty or incorrect in any way, or does not confirm to the original order. Acceptance of returned goods by Mark Farhat Giusti does not guarantees that the goods are acceptable returns.

To arrange a repair you can send your item directly to our repairs centre. If you are sending your repair directly, please include a note detailing the repair you would like carried out, your contact details (including name, address, telephone number and email address), and where possible, a copy of proof of purchase is also helpful.

We recommend you use a traceable method to send your goods, such as DHL or UPS, and make sure the package is wrapped securely. Please send your repair to:

We do not at present acknowledge receipt of parcels but would normally assess and liaise within a time period of 2-4 weeks.

PAYMENTS & TAXES

Mark Farhat Giusti accepts payments through the following methods: Maestro, visa, visa electron, mastercard, amex.

Funds will be deducted from your bank within 72 hours of receiving confirmation of your order.

CONFORMITY OF GOODS

Mark Farhat Giusti takes every care to ensure that descriptions, specifications and visual representations of its products on the website are as accurate as possible, but we cannot accept responsibility for color variation caused by technical limitations, and due to the nature of some Mark Farhat Giusti Limited products and the quality of the raw materials used in production, slight variations in color and texture may occur.

Mark Farhat Giusti Company also aims to continually improve the products available; therefore, design changes may be made at any time.
